ARRC Votes to Amend, Hold H.B. 228

H.B. 228 Removed from Senate Consent; ARRC Meets on March 2

Sen. Heads Up: Deadlines for Rules Specifically Required by 2011 Legislation

Under the provisions of Subsection 63G-3-301(13), when a bill passes that specifically mandates rulemaking (e.g., “agency shall write rules”), the affected agency is required to initiate rulemaking within 180-days of the bill’s effective date.  In other words: For bills effective 05/10/2011, corresponding administrative rules must be filed with the Division of Administrative Rules by 11/06/2011. H.B. 228 Passes Senate Committee

On February 24, 2011, the Senate Government Operations and Political Subdivisions Standing Committee gave H.B. 228, Administrative Rules Reauthorization,  a favorable recommendation and placed the bill on the Senate Consent calendar.  That means that the Senate will pass H.B. 228 on March 1 provided no Senator votes against the bill. On February 17, 2011, the House of Representatives passed the annual Administrative Rules Reauthorization bill.  In its current form, the bill reauthorizes all administrative rules.

S.B. 55 Will Require Rulemaking for Electronic Signatures

Utah Administrative Code Current Through February 1, 2011

The Utah Administrative Code, the body of all effective rules as compiled and organized by the Division, is current through 02/01/2011.  The Division posted this update on its website on 02/10/2011. The Division’s goal is to codify and post rule filings made effective through the first of the month by the tenth of the month.

Administrative Rules Reauthorization Bill Numbered; Reauthorizes All Rules

The annual Administrative Rules Reauthorization bill has been numbered as H.B. 228.  As introduced, it reauthorizes all administrative rules. Rep. C.
